This is a story my best friend told me two months ago and since the whole situation has finally settled here the story.
Me and bestfriend are comission artists but best friend does alot of diffrent art. She also paints walls for businesses, hospitals, old folks home and once a preschool. She has contracts for the people to sign and its hefty since she has to be so thorough with how the process is done, how long itll take and how shell get paid.
My best friend got asked by her aunt to do a nursery for her friend and my best friend was very happy to do it. Got the phone number and met up with the lady. They both agreed to start asap and when my best friend got there she measured out the room and asked what the woman wanted. " I know it might be too easy for someone of your stature but could you do every disney princess on the walls. You know since we are have a girl", she smiled and grabbed my friends arm. She said yea and shell have the contract ready by tomorrow. My best friends boy friend is a student in law so he makes up contracts and gets the materials for her too. My best friend heads back over to the ladys house and the lady doesnt even look at the 11 pages contract. She signs all of it without a second though and they both head to the room with the supplies. My best friend has done disney characters so much that he has most of it down but really wants to make sure. She puts up this special paper, if you draw on one side of the paper the drawing will pop up on the other side. I dont like to use it because it has a faint smell. And the woman freaks out, " That wont poison me will it? You know I'm pregnant right? If anything happens to my baby I'll sue the house from under your nose", shes even more aggressive this time not only grabbing her but digging her nails into my friends arm.
My friend told her it's just a kind of chalk and the woman walks away. So my friend eventually gets done with all the stenciling of all the characters which took 2 days. She gets her water and oil paint markers ready. Unfortunately they have an even stronger smell but my friend thought she had this covered. She opened up the three windows in the room and pulled out a very small battery powered fan and out it in front of the window.
The woman watched like a hawk as my friend paints her heart out. " why are you only doing the skin you do know I want the whole character right", the woman barks staring down at her from the door. " I paint in sections kinda, I do skin then details then dresses then hair and then more details. I promise you that it will look just like them or as close as I can get it". She says and just paints away. So fast forward 2 weeks and the work is done, now it's time for payments.
My bestfriend goes to the lady with her boyfriend and the contract in hand. The lady let's my friend in and they sit at a dinner table together. The ladys husband had to help her since she was way to big to bend down and aim her body right. Anyways my friend lays down the contract and set up a payment plan for them. " Usually I ask for at least 1/3 up front but your saving for your baby and that wont be a problem. But since i did do the same design for 4 walls and 12 princess all together that will be 9,500 all together since you also wanted the trimming done and fine details at the corners of the room. We can do a basic plan which is 50 dollars a month or 100. Anything you feel most comfortable with." My friend says and shes writing down the payments and how much all the material costs. The lady laughed " oh I'm not paying you that much. You'll get 150 dollars and that's the end of it. Hunny get my purse" she yells at her husband who is right next to her. My friend stars at the lady dumbfounded to how she could act so rude. " you know this took 3 weeks to do right? And the materials are well over 150 dollars", she said nervously sliding the contract in front of her to go through. " So what, you dint have children. I'm about to have a baby you never told me it would cost so much and I have a baby to worry about soon not some half baked artist who cant even do nail art right if she had a gun to her head. " My friend was stunned and has really bad anxiety. She shifted in her chair when her boyfriend grabbed the contract and opened it. " ma'am may I remind you, not only did you sign a legally binding contract but if you wont except payment we will take you to court over this. In the contract it states any and all art that isnt paid for will removed. Didnt your husband just build this house", she said. The lady looked at her husband and told him to get her phone. They called the police to get my best friend out of there.
Anyways since those people did end up signing a legally binding contract, and signed it multiple times my friend took them to court. And the lady tried saying everything in the book to vet out of paying. Like the paint she used was toxic and made her sick. My best friend showed up with the paint markers proof of purchase and the box proving they were nontoxic. The lady said she didnt paint the walls the whole way but my friend had taking videos and pictures of the art. The last thing she told me was about the painted walls. The lady told the judge that my friend threatened her and her famliy and said she was going to destroy her house. My friend told the judge about how in the contract it states how any and all unpaid for art will be removed by the artist. And since it was on newly made for walls shell remove the dry wall herself. The judge said that wasnt necessary but did have a good laugh about that. I dont know if she was serious or not.
Anyways the lady tried to stretch bbn out the case as long as possible and painted over my friends work to try to say that they didnt do anything but the videos proved that it was there and everything. They had no leg to stand on. My friend also sued for emotional distress and court costs. The judge passed it. So my friend won and is slowly getting paid.
Tl:Dr: Best friend paint 12 disney princess on 4 walls for her aunts friend. Woman signed contract without reading it and didnt think she was going to have to pay. Friend took her to court and ended up getting more then she thought. Lady is mad and makes monthly payments.
