[Indiana] I've asked the managers multiple times to not let maintenance into my apartment. They listened but it seems that no action was taken. I've caught them having been in here at least 3 times.
My reasoning is that I had half a bottle of some very good medication go missing when I moved in, and maintenance had been in to install ceiling fans and clean the bugs out of the kitchen light while I was at work and requested they make an appointment with me while I'd be home. They did it couple times after that as well.
I like to buy candy to put on my desk at work. I had a box of 32 Cow Tales that I bought for next month's candy bowl. I did not open them and I put them on my end table. I specifically remember them being unopened because I moved the box to the end table to put my old mattress up against the wall until I hire some guys to take all my old crappy furniture away. I did that on Tuesday. Today (Thursday) I came home from work and found the box of candy open and on my dining table. I counted 31 pieces. I did not open that box and I haven't had a Cow Tale in at least 10 years. It's apparent that someone who has a key has been letting themself into my apartment during the work day whenever they please.
I just sent an email (after hours) to the manager to check the RFID key log on my door. I don't have a security camera yet, so I also placed steel nails in my mudroom to see if they'd been coming into my apartment while I'm sleeping. You can't set those back up because the door opens inward.
First of all, is it my right to set up nails this way for storage purposes in a rented domicile? I like to keep my nails in a very specific configuration upright on the floor because it's my hobby and my god given right as an American to pursue this interest as a freedom of expression; it is my art form.
Secondly, what action can I take legally in lieu of the nails to press charges? I don't want to move out because that's expensive and I really like my apartment. Am I limited to just breaking the lease, or can I keep my apartment and pursue any sort of legal action?
